FlexiNet Pty Ltd Privacy Policy
FlexiNet conducts a business which provides internet access, website hosting and other internet related services to members of the public consisting of private individuals, corporations and various other types of organizations who hold subscription and usage accounts with FlexiNet.
When you request the supply of subscription services we will ask you to provide various items of personal data so that we can identify you and contact you should the need arise and this data will be recorded and stored on the FlexiNet servers and paper copies will be maintained in files.
We respect and are committed to protecting your privacy and to formalize this commitment we have adopted this Privacy Policy. This Privacy Policy is to inform you as to how your personal information is processed and used by FlexiNet and we will only use your personal information in accordance with this Privacy Policy.
This policy specifically applies and is only relevant for the web pages, newsletters, discussion lists, emails and other forms of communication which emanate from and are directly related to the business owned and operated by FlexiNet Pty Ltd.
Commercial and taxation law requires that data related to the business accounting be retained for a number of years but once the statutory requirements have been fulfilled, all retained data will be destroyed in accordance with good business practice.
What types of information does FlexiNet collect and how is it collected?
- Account creation:
- Every person or organization that opens a service account with FlexiNet will be required to provide some basic information comprising name, postal address, telephone number and email address. These will allow us to contact you should the need arise. If the subscriber is a company or organization, we are also required by law, to collect information like ACN, ABN and registered and trading names.
- Account payments:
- Certain FlexiNet service accounts may we require you to supply either a direct debit authority or a credit card authorization so that we can debit your service charges automatically. This data will be retained for such periods as determined by the banking authorities.
- Connection and usage data:
- Every computer connected to the Internet is supplied with a domain name and a set of numbers called an IP address, which are used to identify that computer. Without this identifier you would not be able to receive any web pages or email.
- When a visitor requests a page from any web site within the FlexiNet Network, our web servers may automatically recognize that visitor's domain name and IP address. The domain name and IP address reveal nothing personal about you other than the IP address from which you have accessed our site. We use this information to examine our traffic in aggregate, but do not collect and evaluate this information for individuals. Our web servers do not record e-mail addresses of the visitors.
- When you utilize a FlexiNet internet access service, FlexiNet will record details of that usage, primarily for accounting purposes, but in some instances this data may be used to assist technical support personnel in the diagnosis of problems which you may be encountering while using the services.
- Cookies:
- At times FlexiNet or its advertisers may send a "cookie" to your computer. A cookie is a small piece of data that is sent to your browser from a web server and stored on your computer's hard drive.
- A cookie can't read data off your hard disk or read cookie files created by other sites. Cookies do not damage your system. We use cookies to identify which areas of the FlexiNet Network of web sites you have visited or customized, so the next time you visit, those pages may be readily accessible.
- Our advertisers may also use cookies to ascertain how many times you've seen an advertisement. We and our advertisers may use this information to better personalize the content, banners, and promotions that you see on our Sites.
- You can choose whether to accept cookies by changing the settings of your browser. You can reset your browser to refuse all cookies, or allow your browser to show you when a cookie is being sent. - Purchases:
- When you purchase goods from the FlexiNet website we will we need to know your name, email address, mailing address and credit card number details. This allows us to process and fulfill your order and to notify you of your order status.

- We may also request your e-mail address or mailing address for the purposes of conducting a survey or to provide additional services (for example, subscriptions to e-mail newsletters, announcement lists or information about seminars). Whenever we request the identity of a visitor, we will clearly indicate the purpose of the inquiry before the information is requested.
- Parts of the FlexiNet website use a shopping cart feature that safeguards this information by using industry standard SSL (Secure Socket Layer) encrypted servers. SSL encrypts the information transferred between you and the server, rendering it unreadable to anyone trying to intercept the information.
- Wherever FlexiNet collects personal information we make an effort to include a link to this Privacy Policy on that page.
Disclosure of information:
- FlexiNet will only disclose personal information to third parties when required to do so by the law or when we believe, in good faith, that such action is necessary to:
- Conform to the edicts of the law or to comply with legal process served upon FlexiNet Pty Ltd;
- Protect and defend the rights or property of the FlexiNet and it’s associates;
- Identify persons who may be violating the law, the legal notice, or the rights of third parties;
- Co-operate with authorities conducting investigations of purported unlawful activities.
- FlexiNet maintains a strict ‘No-Spam’ policy and we do not intend to sell, rent, or otherwise give your email address to any third-party without your consent unless we are obliged to by law.
- FlexiNet will take all reasonable precautions to keep the information disclosed to us secure.
- FlexiNet reserves the right to transfer information in connection with the sale of all or part of FlexiNet capital stock or assets. Furthermore, we are not responsible for any breach of security or for any actions of any third parties which receive the information.
- The FlexiNet network of websites may contain links to a wide variety of other sites and may contain the advertisements of third parties. FlexiNet is not responsible for their privacy policies, the content of those websites or how they treat information about their users and visitors.
- FlexiNet does not share any of the individual personal information you provide us with the sites to which FlexiNet links, although FlexiNet may share aggregate data with such web sites (such as how many people use our site). Please check with those sites to determine their privacy policy.
- Please be aware that whenever you voluntarily disclose personal information online - for example through e-mail, discussion lists, or elsewhere - that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.
- There are many forms of malware (bad programs), the purpose of which is to harvest email addresses and transmit them to third parties without the knowledge of the owner. All of the data that FlexiNet collects in the course of its business service arrangement with you:-
- will be stored on servers which we have secured in accordance with best practices as are recommended from time to time;
- will be used only by the employees of FlexiNet to carry out the normal functions of the business;
- will only be released to third parties where required by law or as defined elsewhere in this Privacy Policy.
If FlexiNet has reason to suspect that unlawful activity has been, is being or may be engaged in by a customer while utilizing the services that FlexiNet provide, FlexiNet may disclose information about the offender to other parties as a part of our investigations or in reporting the matter to the relevant authorities.
FlexiNet may be required to release information to duly authorized law enforcement agencies under Parts 13, 14 and 15 of the Telecommunications Act 1997.
Credit information which is held by FlexiNet will not be disclosed to any other party except if we are specifically required or permitted to do so under Part IIIA of the Privacy Act 1988 or the Credit Reporting Code of Conduct.
When you make a modem or ISDN call to connect to the internet FlexiNet may receive Calling Line Identification (‘CLI’) in many circumstances where a customer would not expect this to occur, for example, if you have a silent number or use per call blocking. This information will be collected along with other details of the call and will remain in our database and will be subject to the same restrictions as for other data stored by us.
If you, or someone on your behalf, make an emergency services request to one of our employees, all of the essential data which relates to your location and circumstances will be passed to the relevant emergency services operator without prior reference to a supervisor or officer of FlexiNet.
